Subsidies to owners of cinemas to cover investments in certain projects.

This line of subsidies on a competitive basis is aimed at owners of cinemas established in Cantabria and aims to cover investments in innovation projects, digitized and sustainable operation, creation and loyalty of audiences and adaptation to new audiovisual consumption habits.

Applicants must be registered in the Administrative Register of Cinematographic Companies of the Institute of Cinematography and Audiovisual Arts prior to the publication of this Order and have the cinema or complex located in the Autonomous Community of Cantabria.

When the eligible activity is to be carried out jointly by several owners of exhibition halls, in order to obtain the status of beneficiaries they must constitute a group of owners of exhibition halls that will act through whoever the group designates as its representative with the capacity to represent itself to act in the name and on behalf of all the owners of exhibition halls, for the purposes of submitting the application for the aid, the supporting documentation, compliance with the obligations arising from the granting of the subsidy and its justification. The group may not be dissolved until the limitation periods for reimbursement and infringements, where applicable, provided for in Articles 39 and 65 of Law 38/2003, of 17 November, General Subsidies, have elapsed.

All owners of exhibition halls participating in the project must meet the necessary requirements to access the status of beneficiaries of the aid.

The representative of the group must be appointed the one who assumes the greatest commitment to the execution of expenditure. In the event that several owners of cinemas equally assume the greatest commitment to execution, they must be appointed among them.

The application for the aid must state the amount of the aid requested and the commitments to execute the expenditure assumed by each member of the grouping, who will also have the status of beneficiary. Only the owners of cinemas that carry out expenditure may be beneficiaries of the aid, and in each case the aid obtained, added to other public aid received, may not exceed 80% of the expenditure assumed and executed.

For the constitution of the grouping, the standard agreement model will be used. Annex V.

The following people who own exhibition halls will not be able to access these grants:
a) The owners of chambers X.
b) Those that have their tax residence in countries and territories considered tax havens in Royal Decree 1080/1991, of 5 July, which determines the countries or territories referred to in Articles 2, paragraph 3, number 4, of Law 17/1991, of 27 May, on Urgent Tax Measures, and 62 of Law 31/1990, of 27 December, on the General State Budget for 1991.
c) In no case may those who are in any of the circumstances of article 12, paragraphs 2 and 3, of Cantabria Law 10/2006, of 17 July, acquire the status of beneficiaries.

Place(s) for in-person submission

Those interested may submit applications at the Registry of the competent departments in matters of Culture (C/ Lealtad 24, Santander) or through the Common Electronic Registry (REC), available at the Electronic Headquarters of the Government of Cantabria, or at any of the places indicated in article 16.4 of Law 39/2015, of October 1 and article 134.8 of Law of Cantabria 5/2018 of November 22, where appropriate, in accordance with the provisions of Article 14 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations. In any case, legal persons and those who represent them are obliged to interact through electronic means with public administrations.

If the application can be sent by post, it must be submitted in an open envelope to be dated and stamped by the postal employee before he or she proceeds to certify it, in accordance with the provisions of Law 43/2010, of 30 December, on the Universal Postal Service, on the Rights of Users and the Postal Market. and in the regulatory regulations governing this matter.
