Subsidies for the prevention of damage by Iberian wolves and brown bears in Cantabria.

The purpose of this order is to call for aid aimed at financing the compatibility of extensive livestock uses with the presence of large carnivores.
The purpose of the aid is to prevent damage caused to livestock and beekeeping by Iberian wolves and brown bears throughout the territory of the Autonomous Community of Cantabria.

Requirements

1. Any natural or legal person who, at the end of the application submission period, is the owner of an extensive livestock farm and/or a beekeeping farm, in both cases located within the Iberian wolf and brown bear distribution area in Cantabria, may obtain the status of beneficiary. In addition, they must comply with the general requirements of Article 12 of Law 10/2006, of 17 July, on Subsidies of Cantabria.
2. For the purposes of this call, the following definitions apply:
a) Extensive livestock farming: a farm of the type of production and reproduction of cattle, horses, sheep or goats; with the use of pastures or meadows to feed livestock. In the case of cattle and/or horses, their production system will be classified as extensive in the Register of Livestock Farms of Cantabria (hereinafter REGA).
b) Beekeeping farm: a bee production and reproduction farm, registered as such in the REGA.
3. The obligations of the beneficiaries are:
a) Those established in Article 13 of Law 10/2006, of 17 July, on Subsidies in Cantabria.
b) The mandatory provisions on advertising established in the applicable European regulations, in Article 18 of the General Law on Subsidies and in these regulatory bases.
c) Commit to the execution of the activity or project that is the subject of the subsidy.
d) Commit to carry out the maintenance of the actions subject to the aid for a minimum period of 5 years.
e) Commit to carry out adequate livestock management in accordance with the characteristics and requirements of the requested action, defined in each call.
f) Collaborate and cooperate in the corresponding checks carried out in situ by personnel authorised by the competent departments, related to the actions requested.
g) In the case of requesting the acquisition of geolocators for livestock, facilitate access to the GPS position of the animals, if requested by the personnel authorized by the competent department.
h) Strictly observe European, state and regional regulations regarding conflicts of interest, as well as Law 40/2015, of 1 October, on the Legal Regime of the Public Sector, and Law 19/2013, of 9 December, on Transparency, Access to Public Information and Good Governance.
i) Legal entities that are beneficiaries of subsidies or public aid for a minimum amount of 10,000 euros are obliged to publish the annual remuneration and compensation of the heads of the administrative or management bodies, such as president, general secretary, manager, treasurer and technical director, under the terms of article 39.6 of this Law 1/2018, of 21 March, on Transparency of Public Activity.
4. In addition to what is indicated in the previous section, applicants for aid must meet the following requirements:
a) To carry out the actions that are the basis for the granting of the aid, in accordance with these rules and with the corresponding call for applications.
b) To keep the farm in active status in the REGA.
c) In the event of requesting the action set out in article 3.1.a) consisting of the maintenance and/or acquisition of mastiff dogs for the protection of livestock, each mastiff for which the aid is requested must be registered in the Registry of Companion Animals of Cantabria (hereinafter RACIC) with the use of a sheepdog and the applicant for the aid appears as the owner or as the person responsible for the animal. The RACIC must be updated.
5. All the requirements of the beneficiaries, as set out in paragraphs 1, 3 and 4 of this Article, must be maintained throughout the procedure.

Applications must be submitted to the General Electronic Registry of the Administration of the Autonomous Community of Cantabria or to any other registry or place provided for in article 134.8 of Law 5/2018, of 22 November, on the Legal Regime of the Government, Administration and the Institutional Public Sector of the Autonomous Community of Cantabria. addressed to the Directorate-General for Forestry and Biodiversity in accordance with Annex I of this call.

Against the Resolution calling for aid, which exhausts the administrative route, it is possible to file a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Cantabria, in accordance with the provisions of art. 25 of Law 29/1998, of 13 July, regulating the Contentious-Administrative Jurisdiction, without prejudice to the possibility of filing an optional appeal for reconsideration before the Minister of Rural Development, Livestock, Fisheries and Food, in accordance with the provisions of Articles 123 and 124 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations and in Article 149 of Law 5/2018, of 22 November, on the Legal Regime of the Government, Administration and the Institutional Public Sector of the Autonomous Community of Cantabria.
