Any natural or legal person who carries out or intervenes in any of the activities defined in article 4 a) of Order MED/4/2018 and:

  • Has its legal domicile in Cantabria.
  • They have an activity licence under the corresponding heading of the economic activities tax, issued by the town council in which the facility is located.

Art. 14. 2 of the Law 39/2015, of 1 October, of the Common Administrative Procedure of the Public Administrations, establishes the obligatory nature of the electronic management for certain subjects as, for example, a) The juridical persons, b) Entities without legal personality, c) Those who carry out a professional activity for which compulsory membership is required, for the procedures and actions they carry out with the Public Administrations in the exercise of said professional activity. In any case, within this group, notaries and property and mercantile registrars shall be included. d) Those who represent an interested party who is obliged to relate electronically with the Administration, e) The employees of the Public Administrations for the procedures and actions that they carry out with them due to their condition of public employee, in the form in which it is determined by regulation by each Administration.

Register of the departments of Rural Development, Livestock, Fisheries and Food, in that of the Regional Offices, in the General Electronic Register of the Administration of the Autonomous Community of Cantabria or in any other register or place of those provided for in article 134.8 of Law 5/2018, of November 22, on the Legal Regime of the Government, of the Administration and the Institutional Public Sector of the Autonomous Community of Cantabria.

ANNEX I. APPLICATION FOR REGISTRATION IN THE ROPO. SUPPLY SECTOR.

a) Accreditation of the applicant's legal personality. In the event that the request is made by the representative of the entity, accreditation of the representation. b) Activity licence under the corresponding heading of the Economic Activities Tax, issued by the town council in which the facility is located. If the document does not expressly state the municipal authorization for the manufacture, storage and/or sale, as appropriate, of phytosanitary products, it must be complemented with an explanatory report from the corresponding municipal authority. In the event that this document is not provided, the competent body will communicate to the respective City Council the information that affects it due to the location in its municipality of any type of facilities or activities. c) In the case of registration in another Autonomous Community, accreditation of said registration. d) Descriptive report, signed by the company's technical manager, detailing: 1. The type or types of activity to be carried out 2º The list of the establishments involved in the activity or activities in question, specifying whether they are industrial facilities, warehouses, offices or other premises and indicating whether it is a mixed establishment, where feed and/or food for human consumption is also marketed. 3º Location plan and sketch of the facilities, specifying the location of the phytosanitary products. 4. The classes of plant protection products or other means of phytosanitary defence that it intends, markets or manufactures. 5º The list of personnel involved in the activity or activities referred to, specifying the location of their jobs, as well as the training or qualification of those who hold positions or carry out activities required by the regulations. 6. Contract for advice on the sale of phytosanitary products, unless the staff involved in the activity includes a technician with one of the qualifying university qualifications included in Annex II of Royal Decree 1311/2012. e) Justification of the payment of the corresponding fee.

Appeals

Type

Against the resolutions of the head of the General Directorate of Rural Development, an appeal may be filed with the head of the Department of Rural Development, Livestock, Fisheries and Food within a period of one month from the day following the notification of the aforementioned resolutions. The resolution of the appeals will exhaust the administrative route, against which only a contentious administrative appeal may be filed.

Deadline
One month, if the act is express. If this period has elapsed without the appeal having been filed, the decision will be final for all purposes. If the act is not express, the applicant and other possible interested parties may file an appeal at any time from the day following the day on which, in accordance with its specific regulations, the effects of the administrative silence occur.
