Requirements

The employer shall formulate in writing and through electronic means a public and unilateral offer of adhesion to the Consumer Arbitration System.
The offer of adhesion must indicate whether it is opted for arbitration to be decided in equity, in law or indistinctly at the consumer's choice, as well as the period of validity of the offer. In the event that none of these extremes are recorded, the offer will be understood to have been made in equity and for an indefinite period.

Entrepreneurs who have the status of natural persons and carry out different sales or services activities in different establishments, or through distance selling through different channels, must clearly identify in the membership offer the activity or activities for which they make the offer.

Public offers of adhesion made to the Consumer Arbitration System may be denounced before the competent Arbitration Board by the entrepreneur or representative with sufficient power to dispose, either in writing or by electronic means. The denunciation shall take effect one month after the date of its communication to the Arbitration Board, unless a longer period is established in the public offer of adhesion or in the denunciation.
The denunciation shall not affect arbitration agreements validly concluded prior to the date on which the denunciation of the offer of membership must take effect.
