Notification of potentially polluting activities (APCAs).

Inform the competent authority of the construction, assembly, operation, transfer, substantial modification, cessation or closure of industries belonging to group C of the Catalogue of activities potentially polluting the atmosphere referred to in Annex IV of Law 34/2007, of 15 November, on air quality and protection of the atmosphere and amended by Royal Decree 100/2011, of 28 January, which updates the catalogue of potentially polluting activities of the atmosphere and establishes the basic provisions for its application, and by Royal Decree 1042/2017, of 22 December, on the limitation of emissions into the atmosphere of certain pollutants from medium-sized combustion plants and updating Annex IV of Law 34/2007, of 15 November, on air quality and protection of the atmosphere.

Requirements

That the industry belongs to group C of the Catalogue of activities potentially polluting the atmosphere contemplated in Annex IV of Law 34/2007, of 15 November, on air quality and protection of the atmosphere, modified by Royal Decree 100/2011, of 28 January, which updates the catalogue of activities potentially polluting the atmosphere and establishes the basic provisions for its application (BOE no. 25, of 29 January 2011).

Royal Decree 1042/2017, of 22 December, - Correction of errors in Royal Decree 1042/2017 of 15 March 2018, which updates the catalogue of activities potentially polluting the atmosphere and establishes the basic provisions for its application.

The requirements are established in the notification form in Annex I of Decree 50/2009.

Deadlines and submission

Deadline for submission

In the case of commissioning of the installation, the period will be three months from the commissioning.

In other cases, the owner of the installation must inform the competent body for the protection of the atmospheric environment of any proposed modification in the character, operation or size of the installation, including its transfer, substantial modification, cessation or closure, prior to its implementation, as well as of any change that affects the identity or domicile of the operator.
