Issuance of environmental verification reports.

The carrying out of activities or the establishment and operation of facilities, as well as their substantial modification, which may cause inconvenience, risks or damage to people, their property or the environment and do not require an integrated environmental authorisation or environmental impact statement, will require prior verification of their environmental impact, only in the case where they are included in Annex C of Cantabria Law 17/2006. of 11 December, which may be amended by means of an Order of the Minister with competence in environmental matters.

Requirements

The activities and establishments listed in Annex C of the Law of Cantabria 17/2006 must obtain the favourable environmental verification report as a procedure that is a mandatory part of the procedure for the granting of the municipal activity licence provided for in urban planning legislation, without which it cannot be granted.

The corresponding municipal body will send the application for an activity licence addressed to the City Council to the regional council (no deadline is set for this), accompanied by the basic project of the activity to be carried out and its facilities.

Art. 14. 2 of the Law 39/2015, of 1 October, of the Common Administrative Procedure of the Public Administrations, establishes the obligatory nature of the electronic management for certain subjects as, for example, a) The juridical persons, b) Entities without legal personality, c) Those who carry out a professional activity for which compulsory membership is required, for the procedures and actions they carry out with the Public Administrations in the exercise of said professional activity. In any case, within this group, notaries and property and mercantile registrars shall be included. d) Those who represent an interested party who is obliged to relate electronically with the Administration, e) The employees of the Public Administrations for the procedures and actions that they carry out with them due to their condition of public employee, in the form in which it is determined by regulation by each Administration.

General Electronic Registry of the Administration of the Autonomous Community of Cantabria or through any of the means established in Article 134 of Law 5/2018, of 22 November, on the Legal Regime of the Government, the Administration and the Institutional Public Sector of the Autonomous Community of Cantabria.

Required documentation

Basic project of the activity to be developed.

a) Environmental situation of the place where the activity is intended to be located and foreseeable impact, identifying, where appropriate, the effects on Protected Natural Areas, habitats, species and other elements of biodiversity. b) Description of the facility and production processes. c) Natural resources, raw materials, water and energy that will be used or generated in the facility. d) Sufficient documentation to identify substances and facilities intended for the storage of chemical products. e) Origin, type and quantity of the pollutant emissions that will be generated into the air, water or soil, comparing the expected emission levels with those established by the applicable legislation. f) Origin, type and quantity of the waste to be generated, with an indication of the planned management system. g) Systems that will be used to prevent or reduce pollution in terms of polluting emissions and discharges and noise control with the corresponding justification of their effectiveness.
