Authorization of special hours.

To grant authorisation for special opening hours in accordance with their nature to bars, cafeterias, restaurants located in hospitals, road service areas, airports, railway or bus stations or similar places intended for the service of passengers, and those intended for the service of workers with night hours.

Article 28 Law 3/2017, of 5 April, and Articles 6 and 7 of Decree 91//2018, of 31 October, on the timetable regime in public establishments.
Authorisation of special opening hours in accordance with their nature for bars, cafeterias, restaurants located in hospitals, road service areas, airports, railway or bus stations or similar places intended for passenger service, and those intended for the service of workers with night hours.

Article 7.3:
Once the application has been received together with all the above documentation, the procedure will be initiated by the competent department in matters of opening hours, requesting a binding report from the corresponding City Council stating that a formal hearing has been given to the neighbors, if any, who reside within a radius of up to 100 meters from the establishment, as well as that there are no firm administrative sanctions relating to non-compliance with the timetable regime or noise legislation.

In accordance with the provisions of Article 16.4 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations. Interested parties may submit their applications to the following Registries:

  • In the electronic register of the Administration or Body to which they are addressed, as well as in the other electronic registers of any of the subjects referred to in Article 2.1.
  • At Post Offices, in the manner established by regulations.
  • At the diplomatic representations or consular offices of Spain abroad.
