Authorisations granted ex officio in the public port domain (Ports of Cantabria).

To preserve and conserve the physical and legal characteristics of the port public domain in an efficient manner through the authorisation of activities and facilities that are in accordance with port uses in ports owned by the Autonomous Communities.
Activities carried out in the port area that do not require the execution of works and those that require the occupation of the port public domain with removable installations or movable property will require prior administrative authorisation.
The procedure will be initiated by agreement of the Directorate-General responsible for ports, following a report from the unit with functions in the matter, which accredits the need and timeliness of the public call and includes the basic determinations to be included in the terms and conditions governing the tender, which refer to at least:
a) The port or port facility that is the subject of the call.
b) The purpose and characteristics of the activity or facility subject to authorisation and the authorisation regime for the same.
c) Requirements for participating in the competition, criteria for their award and weighting of the same.
d) Term of the authorisation.
e) Deadline for the initiation of the activities or facilities.
f) The application form and the documentation to be submitted by the applicants.
g) The deadline for submitting applications.
h) Guarantees to be constituted, if applicable.

The fee for private occupation or special use of the port public domain: - Land occupation fee: 3.94 euros per square metre per year. - Fee for occupying a sheet of water: 0.98 euros per square metre per year. - Fee for the use of facilities or the public domain: six percent of the cost of the facilities. - Fee for special use of the port public domain: may not exceed 5 per cent of turnover.

  • That the activity carried out in the port area does not require work.
  • That the occupation of the port public domain is to be carried out with removable installations or with movable property.
  • That the term is not more than three years, counting from its granting, including possible extensions. However, authorisations for the use of mooring and anchorage posts for sports and recreational boats for personal and family use, and authorisations for the exercise of activities that are considered port services may be granted for a maximum period of ten years.
  • That there is availability of port areas or facilities for use by natural or legal persons.
