- The transferor must be the holder of basic income support rights.
- The transferee must be an active farmer (except in cases of assignment by succession inter vivos or mortis causa). In the case of transfers of basic aid rights, the rent with land will be required of the transferee to provide documentation proving that all the plots for which the assignment of these rights is requested are at his disposal.
- The rights may only be assigned within the same region of the regime where they were assigned.
