Approval of the Work Plan for activities with asbestos risk.

Before the start of each work with a risk of exposure to asbestos or materials that may contain it, the company that is going to carry it out must obtain an authorisation from the labour authority of Cantabria. To do so, they must submit an application in an official form (Annex III Order EMP/1/2011, of 11 January) and a Work Plan with the content provided for in Article 11 of Royal Decree 396/2006, of 31 March, which establishes the minimum health and safety provisions applicable to work with a risk of exposure to asbestos.

Requirements

  1. The work plan shall be submitted for approval to the labour authority corresponding to the workplace where such activities are to be carried out, except in the cases referred to in section 4 of article 11 of RD 396/2006, of 31 March.
  2. The applicant company must:
    1. Be registered in the Register of Companies with Asbestos Risk (RERA).
    2. Fill in the official application form for approval of the Plan (Annex III Order EMP/1/2011 of Cantabria).
    3. Attach a Work Plan that provides, in particular, for the following:
      1. That asbestos or materials containing it are removed before applying demolition techniques, except in the case that such removal causes an even greater risk.
      2. That once the demolition or asbestos removal works have been completed, it is possible to ensure that there are no risks due to exposure to asbestos fibres in the workplace.
      3. The measures necessary to guarantee the safety and health of the workers who are going to carry out the operations.
      4. Include all the operations to be carried out and be based on a prior assessment of the risk of exposure to asbestos fibres in accordance with Article 5 of Royal Decree 396/2006, of 31 March.
  3. Successive plans (Art. 11.3 RD 396/2006, of 31 March): the company must refer to a single specific plan previously approved by the labour authority of Cantabria.
  4. Single general plans (Art.11.4 RD 396/2006, of 31 March): the applicant company must have its main facilities in the Autonomous Community of Cantabria. It will be accredited that the operations to request this type of plan meet the conditions of "short duration with irregular presentation" or "not programmable in advance". The plans approved under this modality must be updated (submitted to new authorization) if the conditions of execution change.
  5. Once the resolution approving the work plan has been notified, the company must notify the ICASST and the Provincial Labour and Social Security Inspectorate of the start of the work affected by the plan at least three calendar days in advance, using the standard form.
