Application for Registration in the Community Register of organisations adhering to the Community Eco-Management and Audit Scheme (EMAS).

To facilitate the adhesion to the Community Eco-Management and Audit System (EMAS) to any organisation located in the geographical area of the Autonomous Community that intends to improve its overall environmental performance. These may be small organisations that may be subject to certain exceptions in accordance with Article 7 of Regulation (EC) No 1221/2009 of the European Parliament and of the Council, or organisations which, due to their size, are not classified as small organisations according to the definition in EU Recommendation 2003/361.

Requirements

In order to be included in the Community Eco-Management and Audit Scheme (EMAS), the organisation must:
(a) Carry out an environmental analysis of its activities, products and services and, in the light of the results of that analysis, implement an environmental management system covering all the requirements described in Annex I to Regulation (EC) No 761/2001 of the European Parliament and of the Council of 10 March 2001 allowing organisations to join a Community Management and Audit System on a voluntary basis Environmental Standards (EMAS), and in particular compliance with relevant environmental legislation.
b) To carry out, or cause to be carried out, environmental audits.
c) Prepare an environmental statement.
(d) Have the environmental analysis examined, if applicable, the management system, the audit procedure and the environmental statement, and have the environmental statements validated by the environmental verifier.
e) Submit the validated environmental statement to the competent body and, after registration, make it available to the public.

Art. 14. 2 of the Law 39/2015, of 1 October, of the Common Administrative Procedure of the Public Administrations, establishes the obligatory nature of the electronic management for certain subjects as, for example, a) The juridical persons, b) Entities without legal personality, c) Those who carry out a professional activity for which compulsory membership is required, for the procedures and actions they carry out with the Public Administrations in the exercise of said professional activity. In any case, within this group, notaries and property and mercantile registrars shall be included. d) Those who represent an interested party who is obliged to relate electronically with the Administration, e) The employees of the Public Administrations for the procedures and actions that they carry out with them due to their condition of public employee, in the form in which it is determined by regulation by each Administration.

Registration of the General Secretariat of the departments of Development, Housing, Territorial Planning and Environment or by any of the means established in article 134 of the Law of Cantabria 5/2018, of November 22, on the Legal Regime of the Government, the Administration and the Institutional Public Sector of the Autonomous Community of Cantabria.

Application for registration of EMAS Community Register small organisations, in accordance with the definition of micro-enterprises, and small and medium-sized enterprises (SMEs) in Commission Recommendation 2003/361/EC of 6 May 2003, which defines as such those employing fewer than 250 people and whose annual turnover does not exceed 50 million euros or whose annual balance sheet does not exceed 43 million euros. Or, in the case of public entities, authorities managing a population of less than 10 000 inhabitants or other public authorities employing fewer than 250 people and whose annual budget does not exceed EUR 50 million, or whose annual balance sheet does not exceed EUR 43 million. It must be accompanied by the document of the environmental verifier's statement and the environmental statement.
