Aid to shipowners and crew members of fishing vessels with a base port in Cantabria and fishermen on foot, affected by the temporary stoppage of fishing activity.

The purpose of this Order is to establish the regulatory bases, on a competitive basis, for aid to shipowners and crew members of fishing vessels with a base port in Cantabria and fishermen on foot affected by the temporary stoppage of fishing activity in the Autonomous Community of Cantabria in the programming period of the European Maritime Fisheries and Aquaculture Fund 2021-2027, for those cases in which its management corresponds to the Autonomous Community, in accordance with the provisions of Article 18 of Royal Decree 1173/2015, of 29 December, on the development of the European Maritime and Fisheries Fund in relation to aid for the definitive and temporary cessation of fishing activity.

The cases of temporary cessation of fishing activity that may be subject to compensation through the aid regulated in this order are those included in Article 21.2 of Regulation (EU) 2021/1139, of 7 July 2021.

The purpose of the order is to guarantee the competitiveness of the fleet, the viability of the operators and the conservation of fishing resources.

In accordance with the provisions of Article 21 of Regulation (EU) No 2021/1139 of the European Parliament and of the Council of 7 July and Royal Decree 1173/2015 of 29 September 2015 on the development of the European Maritime and Fisheries Fund with regard to aid for the definitive and temporary cessation of fishing activity:
a) Vessels affected by temporary cessation must be included in the third list of the Register of Vessels and Shipping Companies, as well as registered in the General Register of the Fishing Fleet and in possession of the fishing licence and authorisations for the modality and fishing ground to which each call refers.
In addition, they must have carried out fishing activities at sea for at least one hundred and twenty days in the two calendar years prior to the year of submission of the application. These days must have been carried out in the modality and fishing ground specified in each call.
b) Crew members must:
Have worked at sea on board a fishing vessel with a base port in Cantabria, which has been affected by the temporary stoppage, for at least 120 days during the two calendar years prior to the year of submission of the application. These days must have been carried out in the modality and fishing ground specified in each call.
- Be enrolled on board one of the fishing boats with a base port in Cantabria affected by the temporary stoppage of fishing activity.
- Employees must be included in the procedure for suspension of employment contracts or reduction of working hours provided for in section 5 of this article.
- Be registered with the Social Security on the vessel in which they were enrolled at the time of the immobilization of the fleet during the stoppage, and also the employees maintain the employment relationship with the company that owns the vessel in which they were enrolled at the time of the immobilization of the fleet during the stoppage
- Prove a contribution period in the Special Social Security Regime for Sea Workers of at least twelve months throughout their working life.
(c) Fishermen on foot shall:
 - Have carried out fishing activity in this modality for at least 120 days in the last two calendar years prior to the year in which the application for the aid is submitted. The reference to the number of days at sea in this section shall not apply to the eel fishery, in which case they must prove that they are included in the census of eel fishermen in Cantabria.
- Prove a contribution period in the Special Social Security Regime for Sea Workers of at least twelve months throughout their working life.
- Be registered with Social Security at the time of the temporary cessation of activity.
(d) Temporary cessation aid may only be granted if the fishing activities of the vessel or fisherman are interrupted for at least thirty days in a given calendar year.
e) Aid for temporary cessation of fishing activity may only be granted for a maximum duration of twelve months per vessel during the entire programming period of the EMFAF.
f) During the period that can be counted as a temporary stoppage, the fishing inactivity must be total. The ship concerned must remain in port for the entire duration of the port, and may not be dispatched for any activity and it is not necessary for that port to coincide with its home port.

    A contentious-administrative appeal may be lodged against this Resolution within two months before the Contentious-Administrative Chamber of the High Court of Justice of Cantabria, without prejudice to the possibility of filing an optional appeal for reconsideration before the head of the department competent in fisheries matters within a period of one month from the day following its publication in the Official Gazette of Cantabria.
