In accordance with Article 14 of Royal Decree 902/2022, of 25 October, both private legal entities that are included in the definition of SMEs in accordance with the provisions of Annex I of Commission Regulation (EU) 651/2014, of 17 June 2014, and natural persons, may be beneficiaries of the aid. provided that they have their tax residence in Spain, when, in both cases, they meet any of the following conditions:
a) They hold any of the following authorisations in force on the date of application for the aid:- An authorisation for the public transport of goods enabling transport with vehicles or groups of vehicles with a maximum mass of more than 3.5 tonnes, identified by the code MDPE.
- An authorisation for discretionary public transport of passengers by bus, identified with the code VDE.
- An authorisation for the public transport of goods, enabling transport with vehicles of up to 3.5 tonnes maximum mass, identified with the code MDLE.
- An authorisation from a transport operator enabling it to act as an intermediary in the contracting of public transport of goods, identified in the registry with the OT code.
b) On the date of application for the aid, they provide a public urban transport service by bus and are exempt from obtaining any of the authorisations included in letter a) of this section.
c) Intervene in the process of transporting goods as loader/unloader or shipper/receiver, as reflected in Law 16/1987, of 30 July, on the Regulation of Land Transport in the control document and in the ADR.
2. The following may not be beneficiaries of the aid:
a) Companies that are in a situation of crisis, in accordance with the definition made for this purpose in Commission Regulation (EU) 651/2014, of 17 June 2014.
b) Persons or entities in which any of the circumstances listed in Article 13, paragraphs 2 and 3, of Law 38/2003, of 17 November, occur.
c) Companies that are subject to a pending recovery order on any aid or subsidy that has been previously granted to them, either because aid has been declared illegal and incompatible with the internal market, or because of any type of breach of the obligations attributed to them in the concession.
d) Publicly owned companies or entities that are providers of urban public transport services.
