The Grants are part of the new Operational Programme of the European Maritime Fisheries and Aquaculture Fund (EMFF 2021-2027) in accordance with the requirements established in Regulation (EU) 2021/1139 of the European Parliament and of the Council of 7 July 2021 and in the Operational Programme for Spain 2021-2027, approved by Commission Decision C (2022) 8732 final, dated 29/11/2022.
The purpose of the regulated aid is to facilitate access to ownership of the first fishing vessel by young fishermen.

Requirements

- The following may be beneficiaries of the aid regulated in this order:
a) Natural persons who are not more than 40 years of age on the date of submission of the application for aid and have worked for at least five years as a fisherman or have acquired an appropriate qualification (title of Local Fishing Skipper for vessels less than or equal to 12 metres in length between perpendicular or of Multipurpose Coastal Skipper for vessels over 12 metres and less than 24 metres in length between perpendicular).
b) Legal persons that belong 100% to one or more natural persons who each meet the conditions listed in paragraph a). - Support may also be provided under this Article for the first joint acquisition of a fishing vessel by several natural persons, each of whom meets the conditions set out in paragraph 1(a).
- The support provided for in this Article may also be granted for the acquisition of partial ownership of a fishing vessel by a natural person who meets the conditions set out in paragraph 1(a) and who is deemed to have control rights over that vessel by virtue of owning at least 33 % of the vessel or of the shares in the vessel, or by a legal entity which fulfils the conditions set out in paragraph 1(b) and which is deemed to have control rights over that ship by virtue of owning at least 33 % of the ship or the shares in the ship.
- Support under this Article may only be provided in relation to a fishing vessel which:
(a) belongs to a segment of the fleet for which the latest fishing capacity report referred to in Article 22(2) of Regulation (EU) No 1380/2013 shows balance with the fishing opportunities available to that segment at the time the grant is granted, which shall be verified by the administration. However, in the event that a new fleet report enters into force, before issuing the decision to grant the aid, it must be verified whether the equilibrium conditions are maintained in the new report in force.
b) Is equipped for fishing activities.
c) It is not more than 24 metres in total length.
(d) has been registered in the Union fleet register for at least three calendar years prior to the year of submission of the application for support in the case of an artisanal coastal fishing vessel, and for at least five calendar years in the case of another type of vessel.
(e) Has been registered in the fleet register for a maximum of thirty calendar years prior to the year in which the application for support is submitted; and
f) It is operational and registered in the census of the Operational Fishing Fleet and has not requested definitive deregistration.

Against this Resolution, which exhausts administrative remedies, a contentious-administrative appeal may be filed within two months before the Contentious-Administrative Chamber of the High Court of Justice of Cantabria, without prejudice to the possibility of filing an optional appeal for reconsideration before the Minister responsible for fisheries within a period of one month from the day following its publication in the Official Gazette of Cantabria.
