Requirements

1. The ownership of tourist camps and service areas for motorhomes can be transferred by any of the means valid by law.
2. The new owner must inform the Directorate-General responsible for tourism, within a maximum period of one month from the date it has taken place, of the change of ownership. To this end, it shall submit a declaration of responsibility in accordance with the standard form set out in Annex IV.
3. The presentation of the responsible declaration will entail the authorisation of the Directorate-General for Tourism to consult and verify the data accrediting their identity, as well as the census registration with the Tax Agency in the economic activity to be carried out, and the registration of the company with the Social Security, which must be carried out prior to the submission of the application. and for the verification of the payment of the fee for change of ownership of a tourist establishment, which, where appropriate, is due, unless expressly stated otherwise, in which case it will be obliged to provide the corresponding supporting documents.
In any case, the following must be provided:

  • a) For individual entrepreneurs and when acting through a representative, the accreditation of the power of attorney and a photocopy of the document accrediting the identity of the represented. Likewise, in the event that the Directorate-General responsible for tourism has not been authorised to consult and verify the data accrediting the identity of the owner and his representative, in the event that it is a legal person, the interested party must provide the corresponding supporting documents.
  • b) In the case of legal persons, communities of property, civil partnerships, etc., a photocopy of the deed of incorporation and, where appropriate, of its subsequent modifications contracts, bylaws or document proving the incorporation, validity, corporate purpose and identification of its members, and a photocopy of the powers of attorney if they are not clearly deduced from the deed or the document proving the incorporation.

4. The declaration of responsibility shall expressly state compliance with the following requirements:

  • a) Have sufficient legal title to operate the establishment as a tourist camp or service area for motorhomes.
  • b) Have obtained the census registration with the Tax Agency, in the economic activity to be carried out, and the registration of the company with the Social Security.
  • c) Have paid the tourist fees that, where appropriate, are due, due to change of ownership.
  • d) Have notified the competent City Council of the change of ownership.

5. Once the declaration of ownership of the tourist camp or service area for motorhomes has been submitted under the terms established in the previous section, the Directorate General responsible for tourism will proceed ex officio to register it as a preventive measure in the General Register of Tourist Companies of Cantabria. without prejudice to carrying out the appropriate inspection and control tasks in order to verify compliance with tourism regulations and the provisions of articles 6 and 7 as applicable.

At the Registration Assistance Office of the General Directorate of Tourism located in the Science and Technology Park of Cantabria, C/Albert Einstein, 4º 1ª de Santander or in any of the established places referred to in article 134 of the Law of Cantabria 5/2018, of 22 November, of the Legal Regime of the Government, the Administration and the Institutional Public Sector of the Autonomous Community of Cantabria.
If the application is sent by post, it must be submitted in an open envelope so that the name of the office and the date, place, hour and minute of its admission by the postal staff are clearly stated at the head of the first page of the document, in accordance with the provisions of Article 31 of Royal Decree 1829/1999. of 3 December, which approves the Regulation regulating the provision of postal services insofar as it does not conflict with Law 43/2010, of 30 December, on the universal postal service, on the rights of users and the postal market.
